What Is “Wrongful Death?”

“Wrongful death” is a legal term used to describe a situation in which an individual is killed as a result of negligence. This negligence can occur on the part of another person, company, manufacturer, medical professional, or another party and can include intentional, reckless, or careless actions or inaction.

Examples of wrongful death vary widely, but can involve:

  • Workplace accidents
  • Criminal activity
  • Exposure to hazardous chemicals
  • Nursing home abuse/neglect
  • Pedestrian accidents
  • Motorcycle accidents

In the state of Florida, the surviving spouse, children, parents, or any other relative (blood or adoptive) that was dependent upon the deceased individual can seek damages in the event of wrongful death.

The wrongful death claim must be brought forth by the personal representative of the victim’s estate. If no such representative exists, the court will appoint a personal representative of the estate.

Damages Available in Wrongful Death Cases

Wrongful death cases are considered civil claims and therefore, liability in such cases is expressed in terms of monetary damages. If a criminal act led to your loved one's death, it is possible to bring forth a separate criminal charge in court, however, a wrongful death case can only result in monetary recovery for the deceased individual’s estate.

Recoverable damages in Florida wrongful death cases can include compensation for:

  • Loss of support and services previously provided by the deceased individual
  • Loss of companionship, protection, support, and/or guidance
  • Emotional distress as a result of losing a loved one/child
  • Medical, burial, and/or funeral costs paid by surviving family members
  • The value of reasonably expected earnings had the victim lived
  • Estate-related damages, including lost “prospective net accumulations”

While such damages will not negate the pain and suffering you are currently dealing with, they can help ease the financial burden associated with losing a loved one. Our Boca Raton wrongful death lawyers can help you understand your options and pursue a plan of legal action on your behalf.
